TERMS AND CONDITIONS FOR HIRE

•Lotus Limousine Leasing Pte Ltd ("Lotus Limousines") is a luxury stretch limousine hire company, striving to provide the latest and best in limousine quality, technology, comfort and service. Lotus Limousine's aim is to provide an enjoyable and relaxing experience.

Please read this document carefully as it forms part of the hire contract between Lotus Limousines and the prime hirer. The term "prime hirer" referred to herein refers to the person making and paying for the hire, which shall be the addressee referred to in Lotus Limousines' Booking Form ("Booking Form"). It is the prime hirer's sole responsibility to ensure that all passengers in their party are fully aware of, and abide by these Terms & Conditions.

Unless expressly agreed otherwise in writing, these Terms & Conditions shall be an integral part of the contract between Lotus Limousines and the prime hirer, have priority over any other contract document, and apply in relation to the provision of any services by Lotus Limousines. By instructing, requesting or otherwise requiring that Lotus Limousines provide any services, the prime hirer is deemed to have agreed to and accepted these Terms & Conditions. In the event of any conflict between these Terms & Conditions and/or the Booking Form and/or the Payment Form and/or other agreement entered into between Lotus Limousines and the prime hirer, the terms of these Terms & Conditions will prevail.


Booking Times and Related Variations
1 Lotus Limousines and the prime hirer shall agree on the hire date(s), times and collection/return address according to the terms stated in the Booking Form.

2 Any additional required collection and/or drop-off points will be subject to additional charges, as determined by Lotus Limousines, and is subject to Lotus Limousines' approval, which must be obtained and paid for prior to the hire commencement.

3 Any hire period extension is charged on a per hour rate basis, whether the extension required is in hourly multiples and/or parts thereof. The per hour charge shall be determined by Lotus Limousines.
HIRE PERIOD EXTENSIONS MUST BE AGREED WITH LOTUS LIMOUSINES IN WRITING PRIOR TO THE HIRE COMMENCEMENT. WHILST EVERY EFFORT WILL BE MADE TO ACCOMMODATE SUCH REQUESTS, LOTUS LIMOUSINES WILL HAVE THE DISCRETION TO REJECT ANY SUCH REQUESTS, SUBJECT TO OTHER EXISTING COMMITMENTS.

4 Should the hire commencement time and/or return departure time (as the case by be) be exceeded by more than fifteen (15) minutes, Lotus Limousines reserves the right to leave with any passengers already on board. Any passengers not on board will be responsible for securing their own alternative transport. In such cases, Lotus Limousines shall not be liable for providing any refund in such instances.

5 Lotus Limousines operates a strict NON-SMOKING policy in all its limousines. Lotus Limousines has the right to terminate the hire immediately without any refund or compensation whatsoever if the prime hirer or any guests are in breach of the no-smoking policy. Smoking 'stops' may be made if required.

6 Illegal substances and activities are banned. Should this ban be breached in any way, the hire will be terminated immediately without any refund or compensation whatsoever.

7 Lotus Limousines (through its driver) reserves the right to not take the limousine into what he/she deems to be unsuitable areas/terrains. Such areas/terrains include but are not limited to; unadopted roads/lanes, unmade roads/lanes, single track roads/lanes. In such situations, the prime hirer accepts the responsibility of finding alternative means of transport with no recourse to Lotus Limousines. No refund or compensation whatsoever will be provided by Lotus Limousines in such instances.


Passenger Behaviour
1 Passengers are required to treat the limousine with care and are requested to leave it in the same condition it was in at the time of hire commencement. Any damage and/or breakage to the limousine or its contents caused by any passenger will be charged to the prime hirer at NEW REPLACEMENT cost.

2 Seatbelts – Passengers seated in forward facing seats are required by law to wear seatbelts and for your safety we advise the wearing of seatbelts by all passengers. Baby seats should be used in forward facing seats only.

3 Should any passenger display any form of aggressive behaviour (including abusive language) towards any passenger and/or the chauffeur, Lotus Limousine reserves the right to immediately terminate the hire and passengers will be responsible for arranging alternative means of transport, with no recourse to Lotus Limousine. No refund or compensation whatsoever will be provided by Lotus Limousines in such instances.

4 Lotus Limousines (through its driver) may terminate the booking if the prime hirer or any member or their party causes excessive delays, are disorderly or, in the driver's judgement, are unfit to travel. No refund or compensation whatsoever will be provided by Lotus Limousines in such instances.

5 Should any passenger vomits within the limousine at any time, the prime hirer agrees to indemnify Lotus Limousines all costs of cleaning and valeting the limousine.


Traffic Conditions and Mechanical Failure
1 Lotus Limousines makes every effort to ensure timely arrival and departure hire times in accordance with the Booking Form. However, accidents, road closures, traffic jams and force majeure events etc. can possibly cause delays. In such cases, the prime hirer will be informed by the Lotus Limousines (through its staff or driver) communicating the revised times. Lotus Limousines shall be excused from the performance of its obligations in such instances. No refund or compensation whatsoever will be provided by Lotus Limousines in such instances.

2 A fifteen (15) minute grace period shall be allowed for late arrival of the limousine beyond its scheduled arrival time that is not due to any of the events mentioned in Clause 1 above. In the event of late arrival of the limousine, Lotus Limousines will extend the booking for an equivalent period such that the prime hirer enjoys the full period of hire, provided the limousine has no prior commitments.

3 Lotus Limousines' vehicles are serviced regularly and maintained to the highest levels. However, in the unlikely event of a limousine's mechanical failure resulting in its inability to provide the services to the prime hirer, Lotus Limousine will use reasonable endeavours to provide replacement transport (either in a similar limousine or if a limousine is unavailable, any other form of vehicles), subject to location and time restrictions. However, in the event it is not possible to provide a replacement vehicle, Lotus Limousine will cancel the hire and provide a full refund. The prime hirer shall not hold Lotus Limousines liable for any and all losses, damages, claims and expenses whatsoever that the prime hirer or any of its guests may incur or suffer directly or indirectly in connection with or arising from any cancellation of the hire.


Airport Journeys
1 Lotus Limousines accept no responsibility for restricted vehicle access (hump back bridges, width restrictions etc) at any location are not liable for delays caused by re-routed journeys.

2 The number of passengers and suitcases will be determined at the time of booking and will appear in the "booking details" of the Booking Form. Lotus Limousines will not accept any additional passengers and/or suitcases which are not stated in the Booking Form, due to weight and space restrictions.

3 For airport arrival pick-ups, Lotus Limousines will allow an additional fifteen (15) minutes grace period added to the 1st hour of booking.

 

 


Articles Left In Limousine
Lotus Limousines will not be responsible for any loss or damage to luggage or personal property left in the limousine during or after the rental period.


Venue Entry
Lotus Limousines cannot guarantee passenger entry into any particular restaurant/club/venue. Restaurant/club/venue management always reserves the right to refuse entry and/or to impose an entry charge. It is the passengers' responsibility to adhere to the venue's dress code, required conduct and entry rules. The prime hirer is advised to familiarize himself/herself of any club/venue rules well in advance of the hire.


Hire Confirmation and Payment
1 A 50% deposit of the hire charge is required with the completed Mode of Payment form which must be signed by the prime hirer where indicated, before Lotus Limousine is bound to provide the services.

2 The remaining balance of the hire charge is payable in cash or cleared funds prior to the hire commencement.

3 In any event, the prime hirer's credit card details are required to cover any damage and/or valeting as described in 'Passenger Behaviour' - paragraphs 1 & 3 above.

4 A 3% surcharge will be added to any booking balance paid by debit/credit card.


Cancellation Policy
Any cancellation is to be advised by telephone and then confirmed in writing by the prime hirer to Lotus Limousines at 47 Club Street Singapore 069424 or via email at info@lotuslimos.com 1 Wedding – Wedding cancellations must be received in writing by us no later than fifteen (15) days prior to hire.

2 All other cancellation terms are set out as follows:
2.1 3 to 7 days cancellation notice before the hire date – 50% of the total booking fee is payable.
2.2 2 days or less cancellation notice before the hire date – 100% of the total booking fee is payable.


Limitation of Liability
1 Lotus Limousines shall not be liable to the prime hirer for the loss of use of any works, loss of profit, loss of any contract, or for any indirect or consequential loss or damage, whether or not caused by any fault, omission, breach or negligence of Lotus Limousines, arising out of or in connection with the provision of services by Lotus Limousines.

2 The total liability of Lotus Limousines to the prime hirer shall not exceed the total amount of fees collected from the prime hirer in connection with the provision of services by Lotus Limousines.

3 Nothing herein shall limit or exclude the liability of Lotus Limousines for fraud, deliberate default, reckless misconduct, or for negligently-caused death or personal injury.


Miscellaneous
1 The law governing the Terms & Conditions shall be the law of Singapore. 2 Any dispute arising out of or in connection with the Terms & Conditions, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force, which rules are deemed to be incorporated by reference in this clause. The seat of the arbitration shall be Singapore. The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English.

3 Unless otherwise expressly stated in the Terms & Conditions, a person who is not party to the Terms & Conditions shall have no right under the Contracts (Rights of Third Parties) Act to enforce any of its terms.

4No amendment to the Terms & Conditions will be binding on the parties unless set out in writing, expressed as an amendment to the Terms & Conditions, and signed by each party's authorised representative(s).

5 If any term of the Terms & Conditions is or becomes illegal, invalid or unenforceable, that shall not affect the legality, validity or enforceability of any other term of the Terms & Conditions.

6 The rights of each party under the Terms & Conditions may be waived only in writing and specifically. A delay in exercising, or the non-exercise of, any right by any party is not a waiver of that right.
